Ausley McMullen is experienced in representing clients facing government investigations and skilled in handling consumer class actions in state and federal court.

The Antitrust and Trade Regulation team has the experience needed to work on government investigations and private cases involving the Florida Deceptive and Unfair Trade Practice Act (FDUTPA) and related laws, unfair competition claims, CAN-SPAM, RICO, Medicaid fraud, and false claims (Qui Tam) statutes. Attorneys on this team also represent clients in matters involving Truth in Lending laws, the Retail Installment Sales Act, the Fair Debt Collection Practices Act, and Consumer Credit disputes.

Ausley McMullen serves as local counsel for national clients and their attorneys who seek insights into local practices and procedures in state and federal court. Recent examples include putative class actions involving bank overdraft fees, advertising claims regarding healthcare products, “green” claims, and product liability claims.

Members of this team are also experienced in handling multi-state investigations brought by groups of state attorneys general. Recent work includes an airbag recall, a “pay-for-delay” antitrust case involving generic drugs, and the national opioid litigation.

The Antitrust and Trade Regulation team guides clients needing internal investigations, counsels on disclosures required by law, evaluates advertising claims, and establishes compliance policies and systems designed to reduce the risk of government investigations and lawsuits by consumers or competitors.
